PLEASE READ THIS TERMS OF USE AGREEMENT (HEREINAFTER NAMED “ TERMS OF USE ” or “ AGREEMENT ”).

C. Cross The Ages Shop reserves the right, at its sole discretion, to revise, update, change, modify, add elements to, complete or delete certain provisions of this Agreement in view of developments in the Properties, provided nevertheless that material changes to this Agreement will not be applied retroactively without your consent. You can consult the most recent version of this Agreement by clicking on the “ Terms of Use ” link located at the bottom of the Site. It is your responsibility to check periodically for changes to this Agreement. In the event of a material revision, we will notify you in our sole discretion. If any future change to this Agreement is unacceptable to you or results in your no longer being in agreement or compliance with this Agreement, you must object to such change within the aforementioned period or terminate this Agreement and immediately stop using Properties. Your continued use of any Properties after any modification shall be deemed full and irrevocable acceptance of any changes.

V. OWNERSHIP
A. Intellectual Property. All rights and title to the Properties, and all content therein (including, without limitation, computer codes, titles, objects, artifacts, characters, character names, locations, place names, stories, scenarios, dialogues, slogans, works of art, illustrations, structural or landscape designs, animations, sounds, musical compositions and recordings, audiovisual effects, character likenesses and methods of exploitation) are the property of Cross The Ages., a Company of Marseille, or its licensors. The Properties and all related content are protected by European and international laws relating to intellectual property. Cross The Ages and its licensors reserve all rights in and to the Properties, including, without limitation, the exclusive right to create derivative works based thereon. You agree not to create intellectual works based on the Properties, unless expressly stated otherwise by Cross The Ages. Furthermore, except as otherwise provided in this Article, Cross The Ages does not authorize you to use in any manner any trademarks, service marks, trade names, logos, domain names, slogans and/or trade dress of Cross The Ages or its licensors (hereinafter collectively referred to as the “Cross The Ages Marks”) in any case without a written License Agreement. Any reproduction, redistribution or modification of the Properties or use of the Properties not in accordance with this Agreement is expressly prohibited by law and is subject to serious civil and criminal penalties.
B. Submission of Unsolicited Ideas. Cross The Ages Shop values your comments on its services and products but please do not submit any ideas, suggestions or creative materials to us. Neither Cross The Ages nor any of its employees and/or licensors accept or consider any ideas, original creative artwork or other unsolicited works, including without limitation any ideas or suggestions for new or improved technologies, product development, marketing plans, or names for new games (collectively, “Unsolicited Ideas”). Please do not send your Unsolicited Ideas to Cross The Ages or its employees and/or licensors. This policy aims to avoid any misunderstandings or disputes if Cross The Ages Shop's products or services appear to resemble an Unsolicited Idea submitted. If you submit your Unsolicited Ideas to Cross the Ages or any of its employees and/or licensors despite this provision, you acknowledge and agree that, upon its transmission or shipment, you grant to Cross The Ages and its representatives a worldwide, permanent, irrevocable, sublicensable, transferable, assignable, non-exclusive, royalty-free license and right to use, reproduce, distribute, adapt, modify, translate, create derivative works based on your Unsolicited Ideas, present in public, display in public, present in a digital medium, make, have made, sell, offer to sell and import your Unsolicited Ideas, including, without limitation, all copyrights, trademarks, trade secrets, patents, industrial rights and all intellectual property and proprietary rights relating thereto, in any media now known or developed in the future, for any purpose, commercial or otherwise, including, without limitation, the transmission of Unsolicited Ideas to third parties, without compensation to you. If necessary, you agree to sign and produce all documents and take all actions necessary or desirable to ensure that the rights to use the Unsolicited Ideas granted to Cross The Ages and/or its licensors as defined above are valid, in force and enforceable.
VI. CONNECTIONS
The Site may contain links to websites administered by third parties. These links are given by Cross The Ages Shop for information purposes only or may be posted by other users. Use of these links and external websites is at your own risk. The linked sites are not controlled by Cross The Ages shop is not responsible for the content available on other sites. The presence of such links does not constitute Cross The Ages Shop's acceptance of the information or materials on any other site and Cross The Ages Shop will not be held responsible for your access to or use of such sites. .

YOU HEREBY AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS CROSS THE AGES SHOP AND ITS ASSOCIATES, OFFICERS, EMPLOYEES AND LICENSORS AGAINST ALL CLAIMS AND LEGAL ACTIONS, ALL DAMAGES, DAMAGES, LOSSES AND COSTS (INCLUDING FEES OF LAWYERS) DIRECTLY OR INDIRECTLY attributable to YOUR FAULT AND ARISING FROM OR RESULTING FROM YOUR USE OR MISUSE OF THE PROPERTIES OR ANY VIOLATION BY YOU OF ANY PROVISION OF THIS AGREEMENT OR THE PRIVACY POLICY. Cross The Ages Shop reserves the right, at its own expense and discretion, to assume the exclusive defense and control of any action subject to indemnification by you, in which event you will cooperate with Cross The Ages by putting forward all available defense arguments.
VIII. TERMINATION
This Agreement (and any future modifications, if any) will remain in effect until terminated. You and Cross The Ages Shop may terminate this Agreement at any time for any reason or no reason.
IX. MISCELLANEOUS
A. Attribution. Cross The Ages Shop may assign this Agreement, in whole or in part, to any natural or legal person, at any time, with or without your consent. You may not assign this Agreement without the prior written consent of Cross The Ages Shop and any unauthorized assignment by you will be void.
B. Customer Contact. If you have any questions regarding these conditions or if you wish to contact Cross the Ages Shop for any other reason, please contact customer service.
C. Entire Agreement. This Agreement constitutes the entire agreement between you and Cross The Ages Shop, relating to the Site and the subject matter of the Agreement, and replaces all previous or current agreements between you and Cross The Ages Shop.
D. Force Majeure. Cross The Ages Shop will not be held responsible for any delay or impossibility of performance due to causes beyond the control of Cross The Ages Shop, including, without limitation, any impossibility of performance hereof due to circumstances or unforeseeable causes beyond the control of Cross The Ages Shop, such as natural disasters, wars, acts of terrorism, riots, embargoes, actions of civil or military authorities, fires, floods, accidents, strikes or shortages of transportation equipment, fuel, energy or lack of personnel or materials.
E. Location. The Site is administered by Cross The Ages in Marseille, France. Users consulting the Site in countries other than France do so on their own initiative and are responsible for compliance with applicable local laws.
F. Title of articles. The titles of the articles herein are given for information purposes only. They do not affect the interpretation of this Agreement and have no other legal effect.
YOU HEREBY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS TERMS OF USE AGREEMENT AND AGREE THAT YOUR LOGIN TO THE SITE AND/OR YOUR USE OF ANY PROPERTY ON THE SITE EVIDENCES YOUR AGREEMENT TO COMPLY WITH THE TERMS OF THIS AGREEMENT.
